The terms for using Preflight.

What Preflight is

Preflight helps you assess the privacy impact of an activity and produce a Privacy Impact Assessment (PIA). It applies rules drawn from Australian privacy law, reviewed by a qualified Australian lawyer, to the facts you provide. Preflight is decision support, not legal advice. It does not create a lawyer–client relationship. It relies on the facts you enter and does not verify them. Some questions require professional judgment, and Preflight says so where they do. You remain responsible for your decisions and your compliance with the law. Seek legal advice for your particular circumstances.

Your account

You must give accurate information and keep your sign-in secure. You are responsible for activity under your account. Tell us promptly at hello@meetpreflight.com if you think your account has been misused. You must be at least 18 to use Preflight.

Plans, payments and renewals

What's free: describing activities, answering questions and seeing results are free, as are threshold records. What's paid: short and full PIA documents are paid, either one at a time or under an annual plan. Prices are shown on the pricing page in Australian dollars. GST is not charged while we are not registered for GST. Annual plans (Team and Organisation) are billed yearly in advance and renew automatically for another year unless you cancel before the renewal date. You can cancel at any time from the Plans page; your plan then continues until the end of the paid period. The Team plan includes up to 25 PIAs a year. A PIA counts once, when its document is first downloaded. Promo codes give the stated free period. They have no cash value and cannot be combined. Payments are processed by Stripe under its terms.

Refunds and the Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under that law. Apart from those rights, payments are non-refundable, including for the unused part of an annual plan, unless we decide otherwise.

Acceptable use

You must not: misuse Preflight, including by attempting to gain unauthorised access, interfere with its operation, probe its security, or scrape or copy its rules or content in bulk use it unlawfully or to infringe anyone's rights resell or provide Preflight as a service to others without our written agreement Privacy consultants and law firms may use Preflight to prepare PIAs for their clients under their own professional responsibility.

Your content

You own the content you enter and the PIAs you create. You give us a licence to host, process and display your content only to provide Preflight to you. We handle personal information under our Privacy Policy. You are responsible for having the right to enter the content you provide.

Our intellectual property

Preflight, including its software, rules, methodology, text and design, belongs to us or our licensors. You may use the PIAs you create for any lawful purpose. You may not otherwise copy, adapt or redistribute Preflight.

Availability and changes

Availability: we aim to keep Preflight available but do not guarantee uninterrupted service. Changes to Preflight: we may change or update Preflight, including its rules, to reflect changes in the law. Each saved assessment keeps the rules it was made with. Changes to these terms: we may change these terms. If a change materially affects you, we will give you at least 30 days' notice by email. Continuing to use Preflight after a change takes effect means you accept it.

Liability

To the extent the law allows: we exclude all implied terms and warranties not set out in these terms we are not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill our total liability arising from Preflight is limited to the amount you paid us in the 12 months before the claim Where the Australian Consumer Law limits our liability for failing to meet a consumer guarantee, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

Ending your use

You can stop using Preflight and delete your account at any time. We may suspend or close your account if you materially breach these terms, or if we stop providing Preflight; if we stop providing it, we will give reasonable notice and a pro-rata refund of any prepaid annual plan. Clauses that by their nature should survive termination continue to apply.

General

These terms are governed by the law of Victoria, Australia, and the courts of that State and the Commonwealth have jurisdiction. If any part of these terms is unenforceable, the rest continues to apply. These terms, the Privacy Policy and the pricing page are our entire agreement about Preflight.
